Who can sponsor?

You may be eligible to sponsor if

:• the person you want to sponsor is a member of the family class;

• you are 18 years of age or older;• you are a Canadian citizen or permanent resident;

• you live in Canada;• you sign an undertaking promising to provide for the basic requirements of the personbeing sponsored and, if applicable, his or her family members;

• you and the sponsored person sign an agreement that confirms that each of youunderstands your mutual obligations and responsibilities;

• you have an income that is at least equal to the minimum necessary income, the amount ofwhich is published yearly by the Canadian government. You will have to provide us withdocuments that show your financial resources for the past 12 months and prove you arefinancially able to sponsor members of the family class. You may solicit the help of a cosigner.

All family members of a would-be immigrant, whether accompanying or not, must be examined. Ifyou previously made an application for permanent residence and became a permanent resident ofCanada, your family members who were not examined in accordance with Canadian ImmigrationRegulations at the time you made your application, are excluded from the family class and youmay not sponsor them.

Note: The minimum necessary income requirement does not apply if the person you aresponsoring is a child you adopted or intend to adopt in Canada and that child has nochildren of his or her own.

Who cannot sponsor?

You are not eligible to sponsor if you are in default of a previous sponsorship undertaking, of an immigrationloan, of court ordered support payment obligations or of a performance bond (an amount you agreed to payas a guarantee of performance of an obligation under the immigration legislation).

Default of a previous sponsorship undertaking means persons you sponsored in the past havereceived social assistance during the validity period of the undertaking.

Default of an immigration loan means you received a transportation, assistance or Right ofPermanent Residence (previously Right of Landing) Fee loan and have not made a required paymentor are in arrears with your loan payments.

Default of any court ordered support payment obligations means you were ordered by a court to make support payments to your spouse, common-law partner or child and have neglected to do so  

Default of a performance bond means you have not paid the sum of money that became payable to the Canadian government following a promise you made to pay this sum if the person specified in the performance bond that you signed or co-signed did not comply with the conditions imposed on him or her by immigration authorities.If you are in default of a previous sponsorship, of an immigration loan, of court ordered supportpayment obligations or of a performance bond and you submit an application to sponsor, it will be refused even if you are sponsoring your spouse, common-law partner, conjugal partner, or child.

Should you want to sponsor again, you will have to

• repay the full amount of any social assistance payment or repay the debt to the satisfactionof the provincial, territorial or municipal authorities that issued the benefit or ordered youto pay, if you are in default of a previous sponsorship, pay all arrears on your loan, if you are in default of an immigration loan, resolve the family support matter to the satisfaction of the provincial or territorial authorities who ordered the payment, or pay any outstanding bonds for which you are a signer or a co-signer and that became payable;

• submit a new sponsorship application;

• pay new processing fees; and

• meet all the eligibility requirements for sponsorship at that time. You cannot sponsor a person for whom you have submitted a previous sponsorship application and no final determination has been made with respect to that application.

You are ineligible to sponsor if

:• you are in prison;

• you are an undischarged bankrupt;

• you are in receipt of social assistance for a reason other than disability;

• you were convicted of a sexual offence or an offence against the person with respect to- one of your family members or relatives,- one of your spouse’s or common-law partner’s family members or relatives,- your conjugal partner or one of your conjugal partner’s family members or relatives,if applicable, unless you were granted a pardon or five years have passed after theexpiration of the sentence imposed on you;

• you were adopted outside Canada and subsequently obtained a revocation of youradoption for the purpose of sponsoring an application for permanent residence by yourbiological parent;

• you are subject to a removal order; or

• have been convicted of a serious criminal offence, have provided false information toImmigration, or have not met conditions of entry.

Can someone co-sign your undertaking?

Your spouse or common-law partner may help you meet the income requirement by co-signing thesponsorship application. A common-law partner is a person who is living with you in a conjugalrelationship and has done so for at least one year prior to the signing of the undertaking.

The co-signer must:

• meet the same eligibility requirements as the sponsor;

• agree to co-sign the undertaking; and

• agree to be responsible for the basic requirements of the person you want to sponsor andhis or her family members for the validity period of the undertaking.

The co-signer will be equally liable if obligations are not performed.Assets, potential earnings, or assistance from other family members will not be considered.

Fees

You must pay the following processing fees when you submit your sponsorship application:

• $75 for the sponsor;

• $475 for a principal applicant (the person being sponsored) who is 22 years of age orolder, or who is married or in a common-law relationship, regardless of age;

• $75 for a principal applicant who is under 22 years of age and not married or in acommon-law relationship;

• $550 for each accompanying family member who is 22 years of age or older, or who ismarried or in a common-law relationship, regardless of age; and

• $150 for each accompanying family member who is under 22 years of age and not marriedor in a common-law relationship.

Right of Permanent Residence Fee

You will need to pay the Right of Permanent Residence Fee before the application for permanentresidence of the person you want to sponsor can be finalized. We will send you a request to pay this feewhen we are ready to issue the permanent resident visa. The fee is $490 per person for the principal applicantand each accompanying family member.

Exemptions

The following people are exempt from the Right of Permanent Residence Fee:

• your dependent children

• the dependent children of the principal applicant

• a child you are adopting

• your orphaned brother, sister, nephew, niece or grandchild

Canadian citizens and permanent residents living in Canada, 18 years of age or older, may sponsor close relatives or family members who want to become permanent residents of Canada. Sponsors must promise to support the relative or family member and their accompanying family members for a period of three to 10 years to help them settle in Canada.

Under the Canada-Quebec Accord, the province of Quebec has a role in determining sponsorship eligibility for Quebec residents. A son or daughter is dependent when the child:

* is under the age of 22 and does not have a spouse or common-law partner;
* is a full-time student and is substantially dependent on a parent for financial support since before the age of 22, or since becoming a spouse or common-law partner (if this happened before age 22); or
* is financially dependent on a parent since before the age of 22 because of a disability.

Interim Policy on Civil Marriages between Same-Sex Persons

Same-sex couples' access to civil marriage was extended throughout Canada on July 20, 2005, under the Civil Marriage Act. While CIC examines the impact of the Act on its immigration programs, its interim policy, which recognizes the validity of civil marriages between a foreign national and his or her Canadian citizen or permanent resident same-sex partner, will continue. At this time, the policy applies only to the family class (which includes the spouse or common-law partner in-Canada class).
Sponsoring a Relative or Family Member

If you want to sponsor any of the above-listed relatives or family members, you may have to meet certain income requirements. If you have previously sponsored relatives or family members who have received social assistance, you may not be allowed to sponsor another person. Sponsorship is a considerable commitment so you should take this obligation seriously.

If you live in any province in Canada except Quebec and wish to sponsor a relative or family member, you must sign an undertaking with the Minister of Citizenship and Immigration. You must also sign a sponsorship agreement with your relative or family member that outlines your mutual commitments. For Quebec residents, an undertaking will be signed with the province of Quebec.

Applying as a Sponsored Immigrant

If you wish to become a permanent resident of Canada, your relative or family member in Canada must first apply to sponsor you. You must be one of the relatives or family members listed above to be eligible for sponsorship.

Both you and your sponsor need to sign a sponsorship agreement. The agreement outlines your mutual obligations. Your sponsor must promise to support you and your family members financially for three to 10 years so that you will not need to apply for social assistance. How It Works

The BC PNP selects and nominates potential immigrants for permanent residence who have the ability to become economically established in BC, and who will provide significant economic benefits to the province.

The Entrepreneur Program allows applicants with business experience and a legally obtained minimum net worth of $300,000 to immigrate to Canada provided that they commit to managing and owning at least one-third of a business of a defined size for at least one year within three years of landing in Canada.

All applicants must indicate in writing that they intend and will be able to meet these conditions, which are also applicable to all family members.

Conditions are administered by Citizenship and Immigration Canada (CIC) after landing.

In order to qualify as an entrepreneur, you must first meet the regulatory definition of an entrepreneur and then obtain a minimum of 35 points in a selection grid designed to determine whether you will be able to become economically established in Canada.
Do you qualify as an entrepreneur?
To determine whether you qualify to apply under the Entrepreneur Program, answer the following questions.

1. Have you managed and controlled a percentage of equity of a qualifying business for at least two years within the period beginning five years before the date of your application?
2. Do you have a legally obtained net worth of at least CAN $300,000?
3. Can you obtain a minimum of 35 points in the selection grid?

Business Experience

You must have managed a qualifying business (see below) and have had control of a percentage of equity of the qualifying business for at least two years in the period beginning five years before the date of your application for a permanent resident visa and ending on the day a determination is made in respect of your application.

A qualifying business means a business for which there is documented evidence of two of the following. In each of any two years in the period beginning five years before the date of application for a permanent resident visa and ending on the date a determination is made in respect of the application:

1. the percentage of equity multiplied by the number of full-time job equivalents is equal to or greater than two full-time job equivalents per year;
2. the percentage of equity multiplied by the total annual sales is equal to or greater than CAN $500,000;
3. the percentage of equity multiplied by the net income in the year is equal to or greater than CAN $50,000; and
4. the percentage of equity multiplied by the net assets at the end of the year is equal to or greater than CAN $125,000.

Your business must not be operated primarily for the purpose of deriving investment income such as interest, dividends or capital gains.
